Hi everyone. My name is Tina. I am a Taiwanese girl living in Taiwan.
My boyfriend is a dutch who works in UK. He has been living in UK for
five years. Recently we were talking about living together in UK. We
encountered several questions which we didn't get answer on the
internet.

First, he is a dutch man, if he doesn't have plan to move back to
Holland, can he apply a dutch fiancee visa for me?

Second, if I have had a dutch fiancee visa, can I go to UK to join
him?

Third, can he apply a UK fiancee visa for me?

Thanks.
Tina

Your start point is http://www.ukvisas.gov.uk

The EEA family permit may only be available to those who are married,
however if he has been living in the UK for 5 years he may be able to apply
for Indefinite Leave to Remain (ILR). After he has ILR he may be able to
sponsor for a fiancee visa.
http://www.ind.homeoffice.gov.uk has information on how EEA nationals can
upgrade to indefinite leave to remain (settled status).

You should visit:
http://www.ind.nl and
http://www.minbuza.nl

for information on Dutch visas. However it won't help much if you plan to
live in the UK.

him?
No. The UK will not accept a Dutch visa - you require a UK visa.

Third, can he apply a UK fiancee visa for me?
Probably yes, if he acquires UK Indefinite Leave to Remain. You should
confirm this at http://www.ukvisas.gov.uk

He should contact a good UK immigration lawyer for guidance through the
process.

Thanks a lot JAJ, another question. I've never consulted a laywer
before. How much will it cost me normally for consulting? And
approximately, how much will it cost me if I have a lawyer guiding us
to complete the process?

There really is no need to consult a lawyer about this. Your facts are
not complicated.

Firstly your fiance should get UK ILR in his Dutch passport, if he does
not already have that. Then you can apply for a UK fiancee visa, move to
the UK, get married in the UK, then apply for spouse visa in the UK.

Alternatively, if the two of you get married in Taiwan, you could either
apply for a two-year spouse visa, or an EEA Family Permit.

Subject to the point that an EEA family permit means that you wait four
years to get Indefinite Leave to Remain (permanent residence) - and
possibly five years if the time period gets increased - as opposed to two
years on a normal spouse visa.

John, the two year probationary spousal visa is British law, which can't be
accessed without ILR, so it wouldn't be an alternative.

John may respond in his own time, but I think he is suggesting that the
Dutch partner apply for and obtain ILR. This is possible for most EEA
nationals resident in the UK for 4 years.

Once the Dutch spouse has ILR, there exists a *choice* as to whether to
sponsor for a fiance/spouse visa under normal UK law, or an EEA permit.

There are pros and cons to both options. The EEA permit is simpler/cheaper
but it then takes a lot longer to get ILR in the UK.

Exactly right, that is what I was suggesting ... if the Dutch citizen
gets UK ILR then the 2-year spouse visa is an alternative to the EEA
Family Permit.
