Hi there

My name is Satgill and I'm currently a citizen of Malaysia. I would like to find out if I stand a chance to migrate to UK.
My late grandfather and my father were both British Subjects, residing in Malaya at that time and have served in Crown service in the Police Force under Her Majesty's Government.
My father received his Certificate of Registration in 1957 under the British Nationality Act, 1948, Section 6 (1) and became a citizen of UK and Colonies.
I was born in 1958 and my father only took up Malaysian citizenship in 1961, so as to be able to carry on working in the Police Force.
My mother was born in 1935 in Malaya which was a British protected state at that time and was a CUKC when my father received his certificate. She only became a citizen of Malaysia in 1978.
I have never tried to apply for UK migration earlier because the Act kept changing.
Can someone please advice me and I would be very grateful. Thank you.

Satgill.

While you seem to have been a citizen of the UK & Colonies by descent, you
probably lost that status when Malaysia became independent and you became a
Malaysian citizen - having been born in Malaysia to a parent also born
there.

Even if you retained CUKC, you would now have only British Overseas
citizenship, which isn't a great deal of help so far as emigration to UK is
concerned, as BOCs are "subject to control" under UK immigration law.

Sorry!

Dear Paul

I would like to thank you for your reply.

Can you also please let me know what is "subject to control" under UK immigration law. Thank you.

Satgill.

The original poster and his family appears to be from Malaya as opposed
to East Malaysia, so will not have lost his British nationality.
However, I agree that now he will probably be a British Overseas
citizen and will be subject to immigration control.

Basically, Satgill, it means that British Overseas citizens require
permission to enter the UK, in the same way as nationals of most other
countries. I think the point is that, strictly from a UK immigration point
of view, there is little to choose between being a Malaysian and being a
BOC - neither can just move to the UK at will...

Dear Paul

Thank you once again for your informative reply.

Another question? I would like to travel to UK off and on to carry out premium gifts business, will it be a problem moving in and out a few times a year.

Thank you and regards.

Satgill.

I think I'd better defer to an expert, Satgill - I'm not sure of the ins
and outs of business visitors, I'm afraid....

www.ukvisas.gov.uk (http://www.ukvisas.gov.uk/) may answer your questions, though
